The plain-English agreement that covers how you and CloudPerch work together — your account, billing, what's allowed, and the fine print, minus the headache.

These Terms of Service (the "Terms") are the agreement between you and CloudPerch ("CloudPerch", "we", "us") for the hosting, domains, and related services we provide. By creating an account, buying a plan, or otherwise using CloudPerch, you agree to these Terms. If you're signing up on behalf of a company, you confirm you're allowed to bind that company.
We've written this in plain English on purpose. It is the real, binding agreement, but it isn't a substitute for legal advice. Two related documents are part of the deal and worth reading alongside this one: our Privacy Policy (what data we hold and why) and our Cookie Policy (what we set in your browser).
To use most of CloudPerch you'll create an account. You're responsible for what happens under it, so a few honest expectations:
We may suspend access if an account is being used in a way that puts other customers or our platform at risk — see Suspension & termination below.
CloudPerch hosting comes in flat-priced plans — Roost, Perch Pro, Flock, and Aerie, all on fast managed shared infrastructure. "Flat" means what it says: the price you sign up at is the price you renew at.We won't quietly bump your rate at renewal. If we ever change list pricing, existing plans keep their rate for as long as they stay active.
If a payment fails, we'll try again and email you. Sites aren't suspended the moment a card declines — we'll give you a reasonable window to update billing before anything is paused.
CloudPerch is shared ground, and a handful of sites can spoil it for everyone. By using the service you agree not to host, send, or do any of the following:
Our Trust & Safety page goes into more detail on what crosses the line and how to report a problem. Suspected abuse can always be sent to abuse@cloudperch.io. We'd rather work with you to fix an issue than pull the plug, but we reserve the right to act quickly when the platform or other customers are at risk.
When you register or transfer a domain through CloudPerch, we act as your agent with the relevant registry and registrar. A few things to know:
We aim for a 99.9% uptime target on our hosting platform, measured monthly and excluding scheduled maintenance and factors outside our reasonable control. We run on LiteSpeed with NVMe storage, server-level caching, a global CDN, and DDoS protection to keep that promise realistic rather than aspirational.
Real-time and historical uptime, plus any active incidents, live on our status page. If something is wrong, that's the fastest place to confirm it. Planned maintenance is announced there in advance whenever we can, and we schedule it for quiet hours.
Support from real humans is available Monday to Friday. We'll always do our best, but these Terms don't promise that the service will be uninterrupted or error-free — see Disclaimers.
Everything you upload, publish, or store on CloudPerch stays yours. We don't claim ownership of your sites, content, or data. You grant us only the limited permission we need to host, serve, back up, and provide support for them.
We take daily backups with 30-day retentionso a bad afternoon doesn't become a bad week. That said, backups are a safety net, not a guarantee — you're responsible for keeping your own copies of anything you can't afford to lose, and for having the rights to publish what you host with us.
If you close your account, you're responsible for exporting your content first. After termination we may delete your data on a reasonable schedule; once it's gone from our systems and backups, we generally can't recover it.
You can cancel any time from your dashboard. From our side, we may suspend or terminate an account if:
Wherever it's reasonable, we'll warn you and give you a chance to put things right before suspending. For serious or urgent issues — active abuse, fraud, or attacks — we may act first and explain after. If we terminate your account without cause, we'll refund any prepaid, unused hosting fees on a pro-rata basis (domains excepted).
CloudPerch is provided "as is" and "as available". While we work hard on reliability, performance, and security, we don't warrant that the service will be uninterrupted, perfectly secure, or free of every error, and we can't guarantee that it will meet every specific need you have in mind.
To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You're responsible for the content you publish and for complying with the laws that apply to your site and audience.
To the maximum extent permitted by law, CloudPerch won't be liable for indirect, incidental, special, or consequential damages — including lost profits, lost revenue, or lost data — arising from your use of the service, even if we've been told such damages were possible.
Where we are found liable, our total liability for any claim is capped at the amount you paid CloudPerch for the service in the twelve months before the event giving rise to the claim. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
We may update these Terms as CloudPerch grows or the law changes. When we make a material change, we'll update the date at the top of this page and let active customers know by email or an in-dashboard notice ahead of time.
Continuing to use CloudPerch after a change takes effect means you accept the updated Terms. If you don't agree with a change, you're free to cancel before it applies.
These Terms are governed by the laws of the jurisdiction in which CloudPerch is established, without regard to conflict-of-law rules. Any dispute that can't be sorted out amicably will be handled by the courts of that jurisdiction, unless mandatory local consumer law in your home country gives you a different right.
If any part of these Terms is found unenforceable, the rest stays in force. Our not enforcing a right on one occasion doesn't waive it for the future.
